REGULAR SCHEDULED COUNCIL MEETING

June 18, 2007

 

The City Council of the City of Lanett, Alabama, met in regular session on Monday, June 18, 2007, in the Council Chambers of the Lanett Municipal Complex at 6:00 P.M.  The roll was taken and the following were found to be present: Councilmember Duskin, Councilmember Heard, and Councilmember McCoy. Councilmember Malone and Councilmember Yarbrough were absent.  Mayor Oscar Crawley was present and presided over the meeting.

 

Reverend Nellie Giles said the invocation and led the pledge of allegiance.

 

Councilmember McCoy made the motion to amend and adopt the prepared agenda.  Councilmember Heard seconded the motion.  Motion unanimously carried.

 

Councilmember McCoy made the motion to dispense with reading and to adopt the minutes of the regular scheduled meeting of June 04, 2007.  Councilmember Heard seconded the motion.  Motion unanimously carried.

 

Councilmember Heard read “Resolution 06-07-05 City Hall Complex and Recreation Gym Roof Replacement”.  Councilmember Heard made a motion to adopt “Resolution 06-07-05 City Hall Complex and Recreation Gym Roof Replacement”.  Councilmember Duskin seconded the motion.  Motion unanimously carried.

 

Councilmember Heard read “Resolution 06-07-06 Purchase of Two-Acres Site 300 Block of East 18th Street For Placing Hanger Building”. Councilmember Heard made a motion to adopt “Resolution 06-07-06 Purchase Of Two-Acres Site 300 Block Of East 18th Street For Placing Hanger Building”.  Councilmember McCoy seconded the motion.  Motion unanimously carried.

 

Councilmember McCoy read “Resolution 06-07-02 Amend The Present Classification Plan To Extend Steps From 9 to 15”. Councilmember McCoy made a motion to adopt “Resolution 06-07-02 Amend The Present Classification Plan To Extend Steps From 9 to 15”.  Councilmember Heard seconded the motion.  Motion unanimously carried.

 

Councilmember McCoy read “Ordinance 06-07-01 Cable Television Franchise”.  Councilmember McCoy made a motion to suspend the rule for immediate consideration for “Ordinance 06-07-01 Cable Television Franchise”.  Councilmember Duskin seconded the motion.  Roll call vote as follows: Councilmember Heard – Yea, Councilmember McCoy – Yea, Councilmember Duskin – Yea and Mayor Crawley – Yea.  Motion unanimously carried.  Councilmember McCoy thanked Mayor Crawley, City Manager Joel Holley and City Clerk Deborah Daniel.

 

Councilmember McCoy read “Resolution 06-07-09 Charter Pole Attachment Contract”. Councilmember McCoy made a motion to adopt “Resolution 06-07-09 Charter Pole Attachment Contract”.  Councilmember Heard seconded the motion.  Motion unanimously carried.

 

Councilmember Duskin read “Resolution 06-07-08 Transfer Funds In Fire/EMS Department 2007 Budget”.  Councilmember Duskin made a motion to adopt “Resolution 06-07-08 Transfer Funds In Fire/EMS Department 2007 Budget”.   Councilmember McCoy seconded the motion.  Motion unanimously carried. Councilmember McCoy ask Attorney Larry Nix if the contract is extended again would they have to come back before the Mayor and Council. Attorney Larry Nix said yes the contract would have to come before the Mayor and Council if extended for ninety more days.

 

Councilmember Duskin read “Resolution 06-07-04 Extend Huguley Water, Sewer and Fire Protection Authority Contract”.  Councilmember Duskin made a motion to adopt “Resolution 06-07-04 Extend Huguley Water, Sewer and Fire Protection Authority Contract”.     Councilmember McCoy seconded the motion.  Motion unanimously carried.

 

Councilmember Duskin read “Resolution 06-07- 07 Removal and Relocation of Hanger Building” and the lowest bid was Midsouth Construction, Inc. for $135,151.00.  Councilmember Duskin made a motion to adopt “Resolution 06-07- 07 Removal and Relocation of Hanger Building”.    Councilmember Heard seconded the motion.  Motion unanimously carried.

 

 

 

Councilmember Duskin read “Resolution 06-07- 03 Downtown Sidewalk First Street Bid Award” and the lowest bid was from Midsouth Construction Inc. for $12,940.00. Councilmember Duskin made a motion to adopt “Resolution 06-07- 03 Downtown Sidewalk First Street Bid Award”.  Councilmember McCoy seconded the motion.  Motion unanimously carried.  Councilmember McCoy asked where the location was?  City Manager Holley said that it was in the area of the Lanett Masonic Lodge.

 

Councilmember Duskin read “Resolution 06-07-11 J.L.D. Enterprises Assist With Removal of Dilapidated Buildings” and the price per hour is $44.75.  Councilmember Duskin made a motion to adopt  “Resolution 06-07-11 J.L.D. Enterprises Assist With Removal of Dilapidated Buildings”.  Councilmember Heard seconded the motion.  Motion unanimously carried.

 

Councilmember McCoy made a motion to go into Executive Session at 6:23 P.M. for pending litigation.  Councilmember Heard seconded the motion.  Roll call vote as follows: Councilmember Heard – Yea, Councilmember McCoy - Yea, Councilmember Duskin – Yea, and Mayor Crawley – Yea.  Motion unanimously carried.  Executive Session will last 10 minutes.

 

Councilmember McCoy made a motion to come out of Executive Session at 6:35 P.M. on pending litigation.  Councilmember Heard seconded the motion.  Roll call vote as follows:  Councilmember Heard – Yea, Councilmember McCoy - Yea, Councilmember Duskin – Yea, and Mayor Crawley – Yea. Motion unanimously carried.   Councilmember McCoy made a motion on pending litigation to settle case number 3:05 CV 1110-F.  Councilmember Heard seconded the motion.  Motion unanimously carried. 

 

There being no further business, to come before this Council, motion duly made, and meeting was adjourned.
