CITY OF LANETT
REGULAR SCHEDULED COUNCIL MEETING
August 21, 2006
The City Council of the City of Lanett, Alabama, met in regular session on Monday, August 21, 2006, in the Council Chambers of the Lanett Municipal Complex at 6:00 P.M. The roll was taken and the following were found to be present: Councilmember Malone, Councilmember Duskin, Councilmember Heard, Councilmember Yarbrough, and Councilmember McCoy. Mayor Crawley was present and presided over the meeting.
Reverend Gary Armes said the invocation and led the pledge of allegiance.
Councilmember McCoy made the motion to adopt the prepared agenda. Councilmember Duskin seconded the motion. Motion unanimously carried.
Councilmember Yarbrough made the motion to dispense with reading and to adopt the minutes of the regular scheduled meeting of August 7, 2006. Councilmember McCoy seconded the motion. Motion unanimously carried.
Mayor Crawley appointed Janie Huguley to Lanett Housing Authority Board.
Councilmember Malone had nothing this evening.
Councilmember Heard made a motion to adopt “Resolution 08-06-05 – Agreement between the City of Lanett and Local Government Services, LLC, for Cable Television Franchise Management Services”. Councilmember Duskin seconded the motion. Motion unanimously carried.
Councilmember Malone asked how much it was going to cost for the Local Government Services, LLC. City Manager Holley said the cost would be $13, 847.00 and the other cost was not sure of.
Councilmember Heard made a motion to adopt “Resolution 08-06-01 – Policy Annexation”. Councilmember Malone seconded the motion. Roll call votes as follows: Councilmember Malone – Yea, Heard - Yea, McCoy – Nay, Duskin – Yea, Yarbrough – Yea, and Mayor Crawley – Yea. Motion carried. The “Resolution 08-06-01 – Policy Annexation” basically states the City of Lanett’s boundaries are Interstate 85.
Councilmember McCoy said that he did not agree with the “Resolution 08-06-01 – Policy Annexation”, because this resolution is basically telling the citizens who live on a different side of the Interstate and in the unincorporated areas of Chambers County that they are not good enough to be in the City of Lanett. Councilmember McCoy said what right do we have as the City of Lanett those in the unincorporated areas of Chambers County what they can do.
Mayor Crawley said that the City of Lanett would be receptive to overtures from property owners.
Councilmember Malone said that he was appalled that the City of Lanett even had to approve such resolution.
Councilmember McCoy made a motion to adopt “Resolution 08-06-02 – Medical – Dental Insurance Blue Cross Blue Shield of Alabama”. Councilmember Yarbrough seconded the motion. Motion unanimously carried.
Councilmember McCoy made a motion to adopt “Ordinance 08-06-01 – 2nd Reading Sales and Use taxes Codes”. Councilmember Yarbrough seconded the motion. Motion unanimously carried. Councilmember Malone said this is less tax on the automotive tax.
Councilmember McCoy made a motion to decline “Resolution 08-06-03 – Retirees Act 2006-510”. Councilmember Yarbrough seconded the motion. Councilmember Malone said he thinks the City of Lanett could find the money. Councilmember Malone made a motion to table the “Resolution 08-06-03- Retirees Act 2006-510”. Motion to table failed due to the lack of a second. Votes as follows: Councilmember Malone – Nay, Heard – Yea, McCoy – Yea, Duskin – Yea, Yarbrough – Yea, and Mayor Crawley – Yea. Motion carried.
Councilmember McCoy made a motion to adopt “Resolution 08-06-04 – Cooperative Purchasing Association”. Councilmember Yarbrough seconded the motion. Motion unanimously carried. Councilmember Malone asked for an explanation on the “Resolution 08-06-04 – Cooperative Purchasing Association”. Councilmember McCoy explains that when you go and do bids the City
of Lanett would be with ten county region encompassing Calhoun, Chambers, Cherokee, Clay, Cleburne, Coosa, Etowah, Randolph, Talladega, and Tallapoosa Counties. The governing bodies would be called “Alabama Cooperative Purchasing Association”. This will put the City of Lanett in a better position on bidding.
Councilmember Duskin made a motion to form a “Tree Board Committee” with up to seven members” and appoint four members. Councilmember McCoy seconded the motion. Motion unanimously carried. The following are appointed to the “Tree Board” Patsy Williams, Sonia Lanier, Judy Yancy, and Dana Miller.
Councilmember McCoy wanted to thank the members of the “Tree Board Committee”.
Mayor Crawley also wanted to thank Patsy Williams on the “Beautification Committee” and thank the volunteers on the “Tree Board Committee”.
Councilmember Yarbrough thanked the volunteers on the “Tree Board Committee”.
City Manager Holley said he talked with Patsy Williams and the “ Tree Board Committee” ties in with the City of Lanett becoming a certified tree city.
City Manager Holley said the City of Lanett would be applying for up to a $2,000.00 grant to purchase trees. Alabama Power sponsors the application for the grant. City Manager Holley said a lot of our trees are getting old. City Manager Holley thanked Patsy Williams for the work she has done.
City Manager Holley said that the City of Lanett would have a pre construction meeting at 11:00 A.M. at the Lanett City Hall for the airport paving project and another meeting at 1:30 P.M. with the engineers on August 19, 2006.
City Manager Holley said Congressman Mike Rogers would be at Lanett City Hall August 30, 2006.
City Manager Holley said that he spoke to Garden Green LLC and they will come up for a meeting. The demolition of the J.T. Green School is expected to start in November 2006.
City Manger Holley said the Lanett Legends 100 Club is still accepting members and the proceeds will go toward the festivities for the September 29, 2006 celebration, which will be at the Lanett Panther Stadium. The Lanett Panther Stadium will be named Morgan-Washburn Stadium in honor of former coaches Mal Morgan and Dan Washburn. The tickets are $20.00 to the dinner and the game.
City Manager Holley said he got a letter from the IDA thanking the City of Lanett for the $500.00.
City Manager Holley said that the East Alabama Regional Planning and Development Commission would go up on their dues for the next fiscal year to 52C per capita. City Manager Holley said the dues for the year would be $4,106.44 a year and $1,026.00 a quarter.
City Manager Holley said he needed guidance from the Mayor and Council on what the deposit should be for customers cutting on property for a day or two.
Mayor Crawley said that he would like to know what the East Alabama Regional and Planning Commission is doing for the City of Lanett. City Manager Holley said that the City of Lanett would have a work session. City Manager Holley said that he and Jerry Thrower would meet with Bill Curtis Executive of the East Alabama Regional Planning and Development Commission. City Manager Holley said that they would come in and help complete a master plan, mapping, and redo our zoning over the next 4 years. The cost to the City of Lanett will be $10,900.00 a year. Councilmember Malone said this has come up in this administration before.
City Manager Holley said the West Shawmut Sewer Project was supposed to be completed by August 17 but they had several tie ends still left to do and it should be complete by the end of the next week.
City Manager Holley said that he wanted to thank Superintendent Larry Ray and the Electrical Department for the work on the power outage.
City Manager Holley asked the Mayor and Council guidance on the collection on old utility bills and old bad checks.
City Manager Holley asked the Mayor and Council for guidance on how to charge customers that want utilities cut on for a few days to clean up so they can rent the property and thin about smaller deposits.
Councilmember Malone said that the City of Lanett use to have a set amount for this type of service. City Clerk Deborah Daniel said that there use to be a different amount for just lights and water, but the minimum deposit now is $250.00.
Councilmember McCoy said that the $250.00 deposits should be left up.
City Manager Holley said that he did not mean to cause any problems by asking the police department to patrol to the east of the Interstate and he did so because there are still some legal issues until property can be de-annexed.
City Attorney Larry Nix said there are overlapping jurisdictions and the imaginary line is the line of revenue and the overlapping jurisdictions require full police protection throughout.
Mayor Crawley said the City Hall would be closed on September 4, 2006 in observance of Labor Day.
Councilmember Malone asked for the downtown re-development.
Councilmember McCoy said that the grant was not approved, because it said that it was for resurfacing and the downtown did not need it. Councilmember McCoy said that the grant was not approved again and said that the City of Lanett had to have a plan.
Councilmember McCoy said now the City of Lanett applied for a grant for the plan for downtown re-development. The public hearing was held for the grant on the plan.
Councilmember Malone said that he believes the grant writers are part of the City of Lanett problems.
Councilmember McCoy said that the grant writers are the best in the State of Alabama.
Mayor Crawley said the reason for the City of Lanett not to get another grant is because of the West Shawmut Sewer project was not closed in February 2006 like it was suppose to be and the City of Lanett will not be able to any more grants this year.
Mayor Crawley said there are other ways to get the money by using bonds to help clean up the downtown.
There being no further business, to come before this Council, motion duly made, and meeting was adjourned.
