REGULAR SCHEDULED COUNCIL
MEETING
September 3, 2007
The City Council of the City of Lanett, Alabama, met in regular session on Monday, September 3, 2007, in the Council Chambers of the Lanett Municipal Complex at 6:00 P.M. The roll was taken and the following were found to be present: Councilmember Heard, Councilmember Duskin and Councilmember Yarbrough. Councilmember Malone and Councilmember McCoy were absent. Mayor Crawley was present and presided over the meeting.
City Manager Joel Holley said the invocation and led the pledge of allegiance.
Councilmember Duskin made the motion to adopt the prepared agenda. Councilmember Heard seconded the motion. Motion unanimously carried.
Councilmember Duskin made the motion to dispense with reading and to adopt the minutes of the regular scheduled meeting of August 20, 2007. Councilmember Heard seconded the motion. Motion unanimously carried.
Councilmember Heard read “Resolution 09-07-01 Electric Warrants Revenue”. Councilmember Heard made a motion to adopt “Resolution 09-07-01 Electric Warrants Revenue”. Councilmember Yarbrough seconded the motion. Motion unanimously carried.
Councilmember Heard read the second reading and made a motion to adopt “Ordinance 08-07-01 – An Ordinance Authorizing The City’s Electric Revenue Warrants Series 2007, and The City’s Trust Indenture Securing Said Warrants and Other Warrants That May Be Issued Thereunder”. Councilmember seconded the motion. The votes as follows Councilmember Heard –Yea, Councilmember Duskin – Yea, Councilmember Yarbrough – Yea and Mayor Crawley – Yea.
Motion unanimously carried.
Councilmember Yarbrough ask Mayor Crawley to let City Manager Joel Holley to explain the “Ordinance 08-07-01– An Ordinance Authorizing The City’s Electric Revenue Warrants Series 2007, and The City’s Trust Indenture Securing Said Warrants and Other Warrants. City Manager Joel Holley explained that the current administration came in 2004 there was a shortfall and that bond payments were due. At that time, Joe Jolley helped the City of Lanett refinance a portion of the bonds and this helped the City of Lanett get out of the crunch. City Manager Holley said that due to the Hurricane Katrina changed the tax laws in the states affected by the storm and allowed for more flexibility, which enables the City of Lanett now a one-time chance to refinance the other half of the bonds. City Manager Holley said the City of Lanett credit had improved and received an “AAA” rating. City Manager Holley told the mayor and council that the City of Lanett had to make up a laundry list which included clean up downtown Lanett, move the City of Lanett’s public works from downtown, improvement to the Lanett Senior Citizens building with a $250,000.00 grant, to move the hangar the City of Lanett purchased from the City of Valley with the help of Chamber County and erect the new public works. City Manager Holley said other project are air condition for the old City of Lanett Gym, adding sewage to some areas the City of Lanett hopes to bring in the city limits, paving and other projects.
Councilmember Duskin congratulated the Lanett High School football team for winning the ball game over Valley High School football team.
Councilmember Yarbrough said the City of Lanett needs to look for tomorrow.
Councilmember Yarbrough ask Mayor Crawley to let City Manager Joel Holley to clarify some the things that were written in the Valley Times News and the People Voice Newspaper magazine. City Manager Holley said several weeks ago that Mayor Crawley, City Inspector Jerry Thrower and I met with a gentleman who wanted to open a business, but could not determine exactly what kind of business he wanted. City Manager Joel Holley said the license ranged from serving food, serving alcohol, having dances, and renting out for reunion’s and special occasions. City Manager Joel Holley said that he met 10 or 11 times and he finally got a restaurant license, but he is still can not decide if he wanted to serve alcohol. City Manager Joel Holley said that the mayor and council would have to grant the pouring license with certain steps involved. City Manager Joel Holley said the State of Alabama requires that an architectural drawing should be on hand and that if he did not have it the business could not open and this came directly from the State Fire Marshal’s Office. City Manager Joel Holley said he doesn’t know of any “Jim Crowe Laws” on the City of Lanett’s books and that the law had been ruled unconstitutional. City Manager Joel
Holley noted that having live entertainment, but no alcohol, the City of Lanett had a dance hall license on the books that would need to be purchased. City Manager Joel Holley said the City of Lanett tried to be cooperative but can’t bend the rules. City Manager Joel Holley pointed out a foreclosure notice had been printed in the LaFayette Sun on this business. City Manager Joel Holley said that the City of Lanett wants to cooperate and will do anything it can do to bring in legal business to the City.
Councilmember Yarbrough said that he was tired of the City of Lanett employees being called down in the newspaper. Councilmember Yarbrough said he is looking forward to being in Mr. Malone’s personal newspaper (The People’s Voice) himself.
City Manager Joel Holley said that the City of Lanett wants to cooperate and will do anything it can do to bring in legal business to the City.
Mayor Crawley said this business never filed for an alcohol pouring or dance hall license. Mayor Crawley said a city council work session would be held Wednesday, September 12, 2007 at 5:00 P.M. at the Lanett City Hall.
They’re being no further business, to come before this Council, motion duly made, and meeting was adjourned at 6:20 P.M.
