CITY OF LANETT
REGULAR SCHEDULED COUNCIL MEETING
The City Council of the City of Lanett, Alabama, met in regular session on Monday, July 18, 2005, in the Council Chambers of the Lanett Municipal Complex at 6:00 P.M. The roll was taken and the following were found to be present: Councilmember’s Jamie Heard, Kyle McCoy, John Duskin, Mike Yarbrough and Tony Malone. Mayor Oscar Crawley was present and presided over the meeting.
Reverend Horace Blount said the invocation and led the pledge of allegiance.
Councilmember McCoy made the motion to adopt the prepared agenda. Councilmember Heard seconded the motion. Motion unanimously passed.
Councilmember Duskin made the motion to dispense with reading and to adopt the minutes of the regular scheduled meeting of August 18, 2005. Councilmember McCoy seconded the motion. Motion unanimously carried.
Councilmember Malone read Ordinance 09-05-03 – “Amend Ambulance Ordinance to Amend Ordinance 05-01-01”. Councilmember Malone said this is the first reading. City Manager made comments the City of Lanett goes out on a call to a non-transport call and doesn’t get paid. This will be a charge of $100.00.
Councilmember Malone made a motion for the City of Lanett to contract with the Georgia/Alabama Football Association. Councilmember Malone made a motion to authorize the Mayor Crawley to sign the contract. Councilmember McCoy and Mayor Crawley seconded the motion. The contract will be for (1) year. City Manager Joel Holley said the City of Lanett has to sign a contract to call ball games. The City will pay fees of $30.00 per official on each game, provided with (2) officials The City of Lanett warrants that any game that are called off shall be called off at least two(2) hours before scheduled game time and Georgia/Alabama Football Association be notified. Motion unanimously carried.
Councilmember Malone made a motion for the City of Lanett Contract YBOA (Youth Basketball of America). Councilmember Malone made a motion to authorize Mayor Crawley to execute with YBOA (Youth Basketball of America). City Manager comments the YBOA (Youth Basketball of America will operate the concession stands during the ball games and this will be only during football season. Councilmember McCoy seconded the motion. Motion unanimously carried.
Councilmember Malone read a Proclamation for Mack Sanders. Councilmember Yarbrough said Mack Sanders was not there due to illness and his daughter, son, and grandchildren was there to accept the Proclamation.
Councilmember Jamie Heard had nothing this evening.
Councilmember McCoy read Resolution 09-05-01 - “Alabama Open Meetings Act” and made a motion to adopt the resolution. Councilmember Yarbrough seconded the motion. Motion unanimously carried
Councilmember McCoy read Resolutions 09-05-04 - “Retirees Act 2005-316”and made a motion to decline the resolution. The City of Lanett declines to come under this act. Councilmember Yarbrough seconded the motion. City Manager Joel Holley said the City of Lanett will have to fund the retirees raise and the City of Lanett employees have not had a raise in several years. Councilmember Malone asked if the City of Lanett had done this in the past. City Manager said that the City of Lanett can come back and pass this Act 2005-316 at a latter date. The following votes were recorded, Councilmember Malone-Nay, Councilmember Duskin-Yea, Councilmember Heard–Yea, Councilmember Yarbrough-Yea, Councilmember McCoy-Yea and Mayor Crawley-Yea. Motion carried.
Councilmember McCoy read Ordinance 09-05-01 - “Sales and Use Taxes Codes” the first reading. Councilmember McCoy said this would be one (1) percent sales tax.
Councilmember Duskin made a motion to appoint Mike Bass to Chattahoochee Valley Water Supply District Water Board, which was already appointed in another council meeting. The City of Lanett has to re-affirm the appointment. Attorney Nix said that the City of Lanett has to entertain a motion to ratify a previous motion to appoint Mike Bass. The Chattahoochee Valley Water Supply District Board has to
have the appointment made no greater than thirty (30) days prior. Councilmember Yarbrough seconded the motion. Motion unanimously carried.
Councilmember John Duskin read Ordinance 09-05-02 - “Authorizing the Conveyance of Certain Land of the City (Phillips Road)” and put in form of a motion to sale property to J Donnie Bolton for $49,500.00. Councilmember McCoy seconded the motion. Attorney Nix said the City of Lanett will have suspension of the rules on the first reading and make a motion to suspend the rules to give an immediate consideration. Mayor Crawley entertains a motion to suspend the rules and Councilmember Yarbrough made the motion to suspend the rules and seconded by Councilmember McCoy. Mayor Crawley asked for roll call vote Councilmember Malone-Nay. City Manager explained this property was purchased during the term of a former Mayor and Council. The roll call vote was Councilmember Malone-Nay, Councilmember Duskin-Yea, Councilmember Heard-Yea, Councilmember Yarbrough-Yea, Councilmember McCoy, and Mayor Crawley-Yea. Motion failed to pass.
Councilmember Duskin read Resolution No. 09-05-05 - “Hurricane Ivan Disaster Recovery Grant Program” and put in form of a motion. Councilmember McCoy seconded the motion. City Manager Joel Holley, this is related to the Community Development Block Grant (CDBG) which the City of Lanett will receive $400,000.00. Motion unanimously carried.
Councilmember Duskin read Resolution No. 09-05-03 - “Statement of Qualifications” and put in form of a motion. The Mayor is authorized to execute a contract for professional engineering design and inspection services with Goodwyn, Mills & Cawood for a fee consistent with the approved FmHa scale. Councilmember McCoy seconded the motion. City Manager Joel Holley said the City of Lanett has to declare and nominate an engineering firm. City Manager Joel Holley did an evaluation on Goodwyn, Mills& Cawood and a firm from Birmingham, Alabama. Goodwyn, Mills, & Cawood scored the most points. Motion unanimously carried.
Councilmember Yarbrough read Resolution No 09-05-02 - “Mutual Aid Agreement – City of Lanett” and put in form of a motion. The agreement would be between, the City of LaFayette, Chambers County, City of Valley and City of West Point, Georgia. The agreement should be with Mayor Crawley and Chief of Police is hereby authorized to execute the “Mutual Aid Agreement”. Councilmember Duskin seconded and Mayor Crawley seconded the motion. Motion unanimously carried.
Councilmember Yarbrough wanted to make his comments on Chief Mack Sanders son, daughter, and grandchildren for being here tonight. Councilmember Yarbrough said Mack Sanders was one of the greatest. Mayor Crawley wanted to thank the family for coming.
Mayor Crawley asked Mike Bass, how the West Shawmut Project was going and has the project started.
Mile Bass stated the project is going well.
City Manager Joel Holley comments on the map Shawn Gray drew up showing the area that floods every time it rains and this shows the problem that causes the flooding. The City of Lanett Water Department has replaced water meter six (6) times. The problem with the resident, they have a water leak. The resident goes out and turns off the meter and the meter gets run over. The City of Lanett will not fix the meter anymore. Councilmember McCoy asked if the City of Lanett has filed suit. City Manager Joel Holley said the City of Lanett will get a paper judgment. City Manager Joel Holley told the resident to get the leak fixed.
City Manager talked about how great it is to get the Community Development Block Grant. The City Manager made comments on how great the Airport meeting went at the Bridges Travel Plaza. The City of Lanett has not got a ruling on the American Canine Association. The City of Lanett was contacted by the city attorney concerning an employee filing a claim with EEOC and they found there were no bases for the claim and he has 90 days to file a law suit. The City Clerk Deborah Daniel, Treasurer, Jenell Lee, and City Manager Joel Holley are involved with setting up and going with electronic payroll and able to go online to look at the City of Lanett accounts. The City of Lanett is getting set up to take credit card payments. This will help customers to pay utility bills and the City of Lanett will charge a $5.00 fee for taking credit cards (Visa, Master Card, Discover, and American Express). This will help our cash management.
Mrs. Echols has contacted the City Manager Joel Holley from the Lanett City Schools. Mrs. Echols has applied for a grant for a long distance learning project. They want the City of Lanett to be a partner and it will not cost the city anything. If the program is granted, it would allow the use of computers and computer screens so the City of Lanett can do along with school system. The City of Lanett can do
teaching and the teacher my be 2000 miles from here and the City Manager Joel Holley sees great benefits to the police and fire department. The City of Lanett can even have conference with businesses that would like to look at the area and they may be 2000 miles away. The project will benefit our utility department. The City Manager Joel Holley wants the Mayor and Council to give authority to bid on old Shawmut Airport building for $60,000.00. The cost does not include the setting up and moving. The cost to buy this type of building is $500,000.00 to $600,000.00. Councilmember McCoy said based on the City Manager Joel Holley recommendation made a motion that mayor and council to authorize City Manager Joel Holley to execute a bid for $60,000. Councilmember John Duskin seconded the motion. Councilmember Malone commented on the employee pay raises and voted down the pay raise for retirees and does the City of Lanett have the money. Councilmember McCoy said the project has been going on for years. Mayor Crawley comments that he would like to see the city barn moved from the downtown during this administration. Motion unanimously carried.
City Manager Joel Holley would like for Mayor Crawley to set a formal work session. The Mayor and Council have some real issues. The City of Lanett is a member of the Alabama Municipal Electric Authority along with ten other cities, allows us to purchase power at a lower rate, which the City of Lanett has been with for sixteen years. Alabama Municipal Electric Authority increase rate last October 1, 2004 by 4.19% and expect to go up another 6% this October 1, 2005. The City of Lanett did not pass this on to customers. The City of Lanett needs to also look at the rates in the work session. The City of Lanett does not know what the gas rates are going to be this winter and need to prepare the customers. City Manager Joel Holley asks the Mayor and Council to be at the work session and it is very imperative to be there.
Mayor Crawley comments on the airport project being his project. Mayor Crawley can see the airport bringing in revenue for the City of Lanett during football season. The other side of this airport project is when we invite these corporate people in from New York to look at the industrial parks and they would fly in to the airport instead of the other airports that are local and then fly back to New York.
Mayor Crawley welcomed County Commissioner David Easteridge.
City Manager Joel Holley announced on the West Point Lake (clean the shore lines) which will be held Saturday, October 1, 2005 from 8:30 AM until 2:00 PM. If it rains they will re-schedule it on October 15, 2005 and they are actually going to serve lunch.
Valerie Gray came before the council to present a report from the Industrial Board Authority and to thank the City Manager Joel Holley and Mike Bass for the help on projects. Valerie Gray announced that the project is on two industrial sites. The Industrial Board Authority is trying to find some type of grant or some funding to build a $100,000.00 spec building in the Cusseta Industrial Park and also building a spec building on the property in Huguley Industrial Park. The Industrial Board Authority received a grant from Alabama Municipal Electric Authority with no matching funds required from us to do some repair work on the spec building in LaFayette, Alabama. The Industrial Board Authority received a $10,000.00 grant to pass through to East Alabama Water, Sewer and Fire Protection to develop a sewer study and to actually do the preliminary engineering report for sewer for the Cusseta Industrial Park. Some of the board member has attended a tax-exempt bond-financing seminar. The Industrial Board Authority is currently re-bidding the maintenance on the industrial parks.
