The City Council of the City of Lanett, Alabama, met in regular session on Monday, October 3, 2005, in the Council Chambers of the Lanett Municipal Complex at 6:00 P.M. The roll was taken and the following were found to be present: Councilmember’s Jamie Heard, Kyle McCoy, John Duskin, Mike Yarbrough and Tony Malone. Mayor Oscar Crawley was present and presided over the meeting.
Reverend Horace Blount said the invocation and led the pledge of allegiance.
Councilmember McCoy made the motion to adopt the prepared agenda. Councilmember Duskin seconded the motion. Motion unanimously carried.
Councilmember Yarbrough made the motion to dispense with reading and to adopt the minutes of the regular scheduled meeting of September 19, 2005. Councilmember McCoy seconded the motion. Motion unanimously carried.
Councilmember Malone read Ordinance 09-05-03 – “Amend Ambulance Ordinance to Amend Ordinance 05-01-01”. This was the second reading of the ordinance. Councilmember Malone put it in a motion. Councilmember McCoy seconded the motion. Motion unanimously carried.
Councilmember Heard said that he did not have anything and that Councilmember Duskin would read the “Resolution 10-05-02 Electrical Rates Increase”.
Councilmember Duskin read “Resolution 10-05-01 Electrical Rate Increase”. Councilmember Duskin put into a form of motion to adopt “Resolution 10-05-01 Electrical Rate Increase”. Councilmember McCoy seconded the motion. Motion unanimously carried.
Councilmember Malone read “Resolution 10-05-02 Low Income Home Energy Assistance Program”. Councilmember Malone would like to put “Resolution 10-05-02 “in form of a motion. Councilmember McCoy seconded the motion. Councilmember Malone said this will help low income citizens and senior citizens. This will help those citizens who have a high utility bill. Motion unanimously carried.
Councilmember McCoy said the City of Lanett has the second reading of “Ordinance 09-05-01 Sales Tax and Use Tax Codes”. Councilmember McCoy said this is the first reading and Councilmember McCoy put it in a form of a motion. Councilmember Yarbrough seconded the motion. Councilmember Malone questioned the sales tax on automobiles. Councilmember McCoy said this will stay the same. Councilmember asked if it was not on automobiles. Councilmember Malone asked how the grocery stores felt and said that it was not represented by the citizens. Councilmember McCoy disagreed and stated that at the public forum that it was the greatest meeting the City of Lanett ever had. Councilmember Malone made a motion to table the “Ordinance 09-05-01 Sales Tax and Use Tax Codes” and the City of Lanett does not need to do what the City of Valley does and the City of Lanett needs to tax everybody. Mayor Crawley called for roll call Councilmember Malone-Nay, Councilmember Duskin-Yea, Councilmember Heard-Yea, Councilmember Yarbrough-Yea, Councilmember McCoy-Yea, and Mayor Crawley-Yea. Motion carried with one nay vote. Mayor Crawley thanked the Council on the vote. This will help the City of Lanett get back in the black, so the City of Lanett can pay all bills, instead of skipping some bills.
Councilmember McCoy wanted to welcome Superintendent Mr. Looser of the Lanett City Schools for his attendance tonight. Councilmember McCoy said he was at the football game Friday night and at one point the football team was loosing 27-0. Councilmember McCoy wanted to complement the team which is made up of sophomores and freshman. The team almost came back and won, with the scored of 34-28. Councilmember McCoy complemented the team and invites everyone to homecoming Friday night.
Councilmember Duskin brought up the 2nd reading of “Ordinance 09-05-02 – Authorizing The Conveyance of Certain Land of The City (Phillips Road)”. Councilmember Duskin said that the City of Lanett should open it up for sealed bids. Councilmember Duskin said that City Manager Holley said the City of Lanett would run it in the paper. Attorney Nix said state law requires the second reading and consideration. Lawyer Nix said it needs to be put in a motion and second for the consideration of this ordinance and then if the council decides to put it out their for sealed bids to get more money for it and it best not to be passed. Councilmember Duskin put it a form of a motion adoption of “Ordinance 09-05-
02 –Authorizing The Conveyance of Certain Land of The City (Phillips Road) and seconded by Councilmember McCoy.
The City Manager Holley commented that after the first reading of “Ordinance 09-05-02” that the City of Lanett had an individual show some interest and want to make a written offer. Since the first reading the City Manager Holley said three other people had contacted the City of Lanett and one of them offered more money. After discussion with Attorney Nix, the City Manager Holley recommended for the Mayor and Council to vote against the ordinance. The City of Lanett would put a bid notice in the paper and accept sealed bids. The City of Lanett would have bid openings at city hall and accept the highest bid. The city council would consider and accept the ordinance at that time. Roll call voted as follows: Councilmember Malone-Nay, Councilmember Duskin-Nay, Councilmember Heard–Nay, Councilmember Yarbrough-Nay, Councilmember McCoy-Nay, and Mayor Crawley-Nay. Motion failed.
Councilmember Duskin read “Ordinance 10-05-01- Authorizing The Conveyance of Certain Land of the City (Airport). Councilmember Duskin put in a motion to suspend the rules and vote on the ordinance after the first reading. Seconded by Councilmember Yarbrough. Roll call vote as follows: Councilmember Malone-Yea, Councilmember Duskin-Yea, Councilmember Heard-Yea, Councilmember Yarbrough-Yea, Councilmember McCoy-Yea, and Mayor Crawley-Yea. Councilmember Duskin made a motion to adopt 10-05-01; seconded by McCoy. Councilmember Malone asked if this is the land next and this will get the City of Lanett airport ready. Attorney Nix said this is very important to keep the airport project on a time frame. Roll call vote as follows: Councilmember Malone-Yea, Councilmember Duskin-Yea, Councilmember Heard-Yea, Councilmember Yarbrough-Yea, Councilmember McCoy-Yea and Mayor Crawley-Yea. Motion unanimously carried.
Councilmember Yarbrough read a Proclamation for the Lanett High Band Boosters. Councilmember Yarbrough presented the Proclamation to the Lanett High Band Boosters and honored them.
City Manager Holley wants to clear up things discussed in the work session and after talking to Superintendent Looser the City of Lanett does not pay for the fuel to run the school buses. City Manager Holley said that Jerry Thrower and City Manager Holley talked about replacing all other pictures on the wall and this would involve using anchors, so it would be done properly. City Manager Holley said that the City of Lanett will be saying pardon our progress at the Lanett Airport. The City of Lanett will be issuing a NOTAM which stands for notice to airman and that has to go through the Anniston Flight Services Headquarters, in Anniston, Alabama. The City of Lanett Airport will be closed during our construction phase. The FFA requires closing at least 700 feet of runway on each end that you are operating on and with passage of this ordinance tonight. Attorney Nix will be able to close the purchasing sale of the Knight property, which will allow the City of Lanett to address some concerns at the airport on that end of the runway. City Manager says it is nice to say pardon our progress and the City of Lanett is excited.
City Manager Holley commented that he had been working on the gas rates. The City of Lanett has been buying from Texican, which is a broker for the City of Lanett. City Manager Holley informed our Agent John Swain this past Friday verbally and the City of Lanett will not be renewing the contract, which comes up in November 2005. The City Manager and William Ray spent the whole day with a representative with MGAG, which stands for Municipal Gas Authority of Georgia. It is a public not for profit organization that was created by the Georgia Legislature in the year of 1987. It is the largest in the United States. They have members in Georgia, Alabama, Florida, Tennessee, Pennsylvania, and Connecticut. They only represent Municipalities and the City of Lanett wants to become a member of that organization. The closest cities to the City of Lanett that already members are the City of West Point, Georgia and Roanoke, Alabama, along with Wadley and Wedowee, Alabama. They are like the electric co-op the City of Lanett belongs to and it will save the City of Lanett. This will allow the City of Lanett to be represented by a public not for profit authority that will allow the City of Lanett to join the ranks. This means the City of Lanett will be able to buy gas at the same price as other members do. The first year the City of Lanett could save about $60,000.00 and plus the financial information and they are located in Kennesaw, Georgia. City Manager Holley will have a resolution ready at the next council meeting. City Manger Holley and Jerry Thrower will be putting together a program to air for the media about the gas rates. City Manager Holley has a DVD provided by the State Aviation Department and it
is the video that some of us saw at the airport meeting and it is about 20 minutes and it shows the value of a local municipal airport. The City Manger Holley is going to loan this video to our local TV station.
City Manager commented on drawing up specs and bid out other than house hold garbage pick-up and brush pick-up. This will save the City of Lanett. City Manager Holley told the Mayor and Council in the
work session he discussed about the current position of Fire Chief and put in each of your boxes a job description for that position. The City Manager Holley would like your input or any changes for that position, before the City of Lanett fills the position.
Two individuals, who own property in the City of Lanett are offering to sale their property and contacted the City Manager Holley. The City Manager will pass it on to the mayor and council. One of the properties is owned by David Holladay next to the Senior Citizen building, for $40,000.00. The other property is owned by Dan Thompson at 308 and 310 First Street, which is the old Dr. Thompson building and he is offering for $38,000.00 and $27,000.00 and if the City of Lanett bought both properties for $60,000.00 and he will knock off $5,000.00.
The City Manager Holley will be setting up a work session for the Finance Committee to address 2005-2006 budgets.
The City Manager Holley introduced new employee Kelly Hinkle as the new Administrative Assistant. City Manager said Mrs. Hinkle jumped right in there and helped on taking a credit card on the phone. Mrs. Gunnells is still here and has been assigned to a new position which is specializing in personnel and insurance. Mayor Crawley welcomed new employee Kelly Hinkle.
Yolanda Thomas came before the Mayor and Council from Alatax to give a brief update on the tax collection. The tax‘s collected is up 1 ½ percent. The contract is coming up and Alatax hopes the City of Lanett will re-sign the contract. Alatax is also collecting back license for the City of Lanett in the sum of $50,000.00 and the City of Lanett gets $25,000.000 and Alatax gets $25,000.00. This is the agreement that the City of Lanett has with Alatax.
